Sweepstakes Checking™ Rules

1. The Sweepstakes is open to all eligible members of Hoosier Hills Credit Union.

2. Eligibility Qualifications: To qualify for the Sweepstakes, entrants must:
• be at least 18 years old,
• have both a savings account and a checking account with Hoosier Hills Credit Union (HHCU) and the accounts must be in “good standing” during the period of and at the time of the Sweepstakes drawing,
• “Good standing” means a balance of at least $5.00 in an HHCU savings account, a checking account and none of the following:
- loan (including credit card) delinquencies beyond the 15 day grace period provided by the terms and conditions of the account;
- a negative balance on any savings or checking account over 30 days as provided by the terms and conditions of the account;

HHCU and the Independent Audit Firm, along with their respective Officers, Directors, Volunteers, Employees and anyone living in their homes are not eligible. 

3. To Enter:  If you meet the eligibility qualifications, you will automatically be entered into the Sweepstakes. The eligibility for the first Sweepstakes drawing will be determined based upon Eligibility Qualifications as of  April 1, 2007.  If you are eligible, you will be automatically entered  as of April 1, 2007.  Once you are entered, you may earn additional entries as outlined in the Earning Rewards section below. You will automatically receive the additional number of entries earned under the Rules.

4. Earning Rewards: All eligible consumer checking accounts get one automatic entry. Additional entries are automatically entered based upon the point system set forth below. Each one (1) point is worth an additional entry to the Sweepstakes. Points are based upon monthly activity during a calendar month. For illustrative purposes, the activity is measured for the period beginning at 12:01 A.M on the first day of a month and ending at midnight on the last day of the month. Points accumulate only for a specific month for the drawing that follows on the 10th of the next month.  Points start accumulating at 12:01 A.M. on the first of the month with the automatic entry point and such other points as are accumulated during that month.

The Average Daily Balance of the checking account is figured at the end of the month. The checking account Average Daily Balance points are earned as follows:

Additional points are earned for the following activities:
• Open New Primary Checking Account = 250 points for the month the account is opened (one time allotment)
• Sign up for Bill Pay = 250 points for the month the account is opened (one time point allotment)
• Each month Bill Pay remains active = 25 points per month
• Sign up for E-Statements = 250 points for the month E-Statements is started (one time allotment)
• Each month E-Statements is active = 25 points per month
         
ACH/Direct Deposit/Payroll Deduction = 250 points for each activity for the month the activity is opened (one time allotment)
• Each month ACH/Direct Deposit/Payroll Deduction remains active = 25 points for each month each is active

Debit Card
• New card issued = 250 points during the month issued
• Each month Debit Card remains active = 25 points per month

5. Prize Drawings: On or before the tenth day of each month Sweepstakes Checking is being offered, a random drawing will be conducted to award Twenty-Five (25) prizes, as set out below, as well as Twenty-Five Charitable donations in the same number and dollar amounts.

  • Six (6) $100.00 winners at the Bedford Branch
  • Five (5) $100.00 winners at the Mitchell Branch
  • Five (5) $100.00 winners at the Paoli Branch
  • Four (4) $100.00 winners at the Jasper Branch
  • Four (4) $100.00 winners at the Valley Branch
  • One (1) $100.00 winner at the Spencer County Branch
The drawings will be certified by an independent auditing firm to ensure objectivity. Twenty-Five (25) winning  member account numbers will be drawn and a member account is limited to winning only one prize per monthly Sweepstakes Checking™ drawing. In order to win, the member account must satisfy the Eligibility Qualifications set forth in these rules. Members need not be present to win. HHCU will notify the owners of the winning accounts by telephone and/or certified mail, utilizing the most recent telephone and/or address information contained in the HHCU files concerning the winning account.  In the event the owner of a winning account does not respond to the notice of winning provided by HHCU by the 10th of the following month, the prize may be declared unclaimed, the winning account declared ineligible for that specific prize and the prize may be added as an additional prize to the next Sweepstakes Checking™ drawing. If a winning member does not accept his/her prize after receiving notification or refuses to accept the prize, the prize will be declared unclaimed and it may be added as an additional prize to the next Sweepstakes Checking™ drawing. HHCU reserves the right to end the Sweepstakes Checking™ drawings at any time. The Sweepstakes Checking™ program will be immediately discontinued should an authority determine that the Sweepstakes Checking™ program is not in accordance with an applicable law, rule or procedure.

6. Claiming a Prize:
Prize winners may be required to personally come into a HHCU office and produce identification sufficient to establish that the member is the owner of the winning account, sign an affidavit of eligibility and sign a publicity release which must be returned prior to acceptance of the prize. Winners agree to permit HHCU to use their name, likeness, and City/County of residence for advertising and promotional purposes without additional compensation, unless prohibited by law. All participants agree that HHCU may record a telephone call to the owner of a winning account for the purpose of later using the owners initial oral reaction to the notification of winning for promotional purposes. A winner whose reaction has been recorded agrees to not unreasonably withhold consent to use the recorded statements in whole or in part. The use of the recording, in whole or in part, is within the sole discretion of HHCU once consent has been obtained. No additional compensation will be paid for the consent or use of the recording. If a winning account is jointly or severally owned, the prize will be deposited to the winning account and it is the responsibility of the account owners to determine how the prize is to be divided. HHCU’s responsibility ends at the time the prize money is deposited to the winning account.

7. Prizes:
Prizes will be Twenty-Five (25) $100.00 prizes and Twenty-Five (25) $100.00 charitable donations. All prizes will be in the form of a direct deposit into the winning membership account number and the deposit will be subject to all account agreement terms and conditions. Each winning account will be entitled to select a Charitable Organization to receive a $100 donation in the name of the account holder. This donation will be made by the Credit Union to the named Charitable Organization in the name of the Sweepstakes Checking™ winner. Charitable Organization is defined as being a 501(c)(3)organization as defined by the Internal Revenue Code and related rules, registered with the IRS and  approved by the Credit Union. Sweepstakes Checking winners can choose from a list maintained by the Credit Union or select one of their own choosing. However, the Credit Union reserves the right to refuse to make any donation for any reason, even if the organization meets the criteria in these rules. Should a Sweepstakes Checking™ winner be unwilling or unable to select a qualified Charitable Organization, the Credit Union may make a donation in its own name to a Charitable Organization of its own choosing or declare that particular prize void and make no donation. In the latter case the Credit Union may choose to re-award the donation the following month or choose not to award the donation at all. Each Sweepstakes Checking™ drawing will consist of 25 prizes awarded and 25 Charitable Donations made as outlined in these rules for a total value of $5,000 in prizes being awarded each month the Sweepstakes Checking™ program is offered.

8. Opting Out of the Sweepstakes:
Any member may advise HHCU that the member does not want to participate in the Sweepstakes (Opting Out). The member must advise HHCU that the member is the owner of the account and provide the same information to HHCU as would be required to complete a normal business transaction for the account. Upon receiving the described instructions from the member, HHCU will withdrawal the member and the member’s account from the Sweepstakes. A single member of a jointly or severally owned account has the ability to withdrawal the account from the Sweepstakes so long as the withdrawal meets the same criteria as required to complete a normal business transaction for the account; disputes between members of jointly or severally owned accounts are the responsibility of the member(s) and HHCU has no duty or obligation to mediate or otherwise resolve such a dispute. A member may opt out of the Sweepstakes at any time but opting out after the member has been advised that the member has a winning account will result in the prize being declared unclaimed unless the member claims the prize in accordance with these rules and chooses to opt out of future Sweepstakes drawings.

9. General Conditions:

• The Credit Union reserves the right to make changes to the Official Rules without notice and is not responsible for printing errors or omissions.

• These rules are the official rules and supersede any published advertisements. 

• By entering the sweepstakes, participants agree to release and hold harmless Hoosier Hills Credit Union, its subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with the Sweepstakes or receipt of a Prize. The Credit Union and each of its officers, directors, employees, members and representatives and agents are not responsible for any negligence, claims, liability, injury, property loss or other damages of entrants and/or winners arising from, or in connection with acceptance, receipt, possession or use/misuse of the prize awarded or participation in this Sweepstakes.

• Hoosier Hills Credit Union is not responsible for error or technical malfunction which prevents an entry from being made or received. The HHCU is not responsible for incorrect or inaccurate information, whether caused by tampering, hacking or by any of the equipment or computer programming associated with the Sweepstakes.

• Any member who fails to follow the Official Rules or makes any misrepresentations relating to the Sweepstakes or the redemption of a Prize is subject to disqualifications at the discretion of the Credit Union.

• Entries by ineligible persons, fraudulent entries, or erroneously created entries will be disallowed. Hoosier Hills reserves the right to void or reverse any award obtained fraudulently or illegally and seek appropriate remedies to recover any prizes.

• All issues and questions concerning these Official Rules will be governed by, and construed in accordance with, the substantive laws of the State of Indiana, USA, without regard to choice of law rules.

Except where prohibited by law, as a condition of participating in the Sweepstakes Checking™ product, entrant agrees that (1) any and all disputes and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association (“AAA”) and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrants out-of-pocket expenses (i.e. costs associated with entering sweepstakes) and entrant further waives all rights to have damages multiplied or increased.
